Automated Comparison Disclaimer

LexAural offers automated computational tools that compare musical recordings and identify passages or musical features that may merit further attention. Automated comparison results are preliminary, may contain errors or omissions, and do not constitute legal advice, a forensic musicological opinion, an expert report, or a determination of copying, protectability, substantial similarity, or infringement.

Users should not rely on an automated comparison report as the sole basis for filing, defending, settling, or abandoning a legal claim. Any preliminary professional review, formal musicological report, or expert witness service is a separate service and is defined by a separate written engagement. Submission of materials for automated comparison does not by itself create an attorney-client relationship, expert engagement, or other professional relationship.

Automated analysis may be affected by transcription errors, vocal separation, tempo or rhythm alignment, recording quality, overlapping instruments, arrangement, transposition, and other musical or technical factors. Users remain responsible for evaluating results with qualified legal counsel and, where appropriate, a retained musicologist.

1. Information We Collect

We collect and process the following types of information:

• Identity and Contact Data: Name, email address, professional affiliation, and organization.
• Technical Data: IP address, browser type, device, and operating system.
• Usage Data: Pages visited, time spent on site, click behavior, and referral sources.
• Communication Data: Form submissions, professional service requests, and any correspondence sent to us.
• Account and Team Data: Account identifiers, authentication records, team membership and roles, case file membership, invitations, activity history, and credit and seat activity.
• Uploaded Music and Case File Data: Audio recordings, file names, file metadata, case file and comparison names, marked passages, whether each part is sung or played, notes, comments, and materials submitted with a professional service request.
• Analysis Data: Note data transcribed from recordings, vocal tracks separated during processing (not kept afterwards), timing and rhythm information, similarity measurements, labels, identified passages, automated reports, and feedback associated with a comparison.
• Transaction Data: Purchase, seat subscription, invoice, payment-status, and limited billing information. Payment card information is processed by our payment processor and is not stored in full by LexAural.

2. How We Collect Information

Information is collected through forms on our website, email exchanges, and automatically via browser cookies and analytics tools.

For portal users, information is also collected when you create or access an account, upload recordings, mark passages, provide case file details or feedback, invite team members, request a professional service, or buy or use credits or seats. The portal also creates records necessary to authenticate users, operate teams and case file access, process recordings, generate automated reports, maintain security, and administer billing.

3. How We Use Your Information

We use your data to:

• Respond to consultation and contact requests
• Deliver and improve services
• Evaluate client needs and suitability for projects
• Enhance website experience through behavioral analytics
• Comply with legal and regulatory obligations
• Authenticate users and administer accounts, teams, and case file access
• Store, process, transcribe, and compare recordings at the user's request
• Generate, display, and preserve automated comparison results and user comments
• Process credits, seat subscriptions, invoices, and payment status
• Prevent misuse, protect account security, investigate technical problems, and maintain service reliability

Uploaded recordings and case file materials are processed by the system to produce your automated comparison report. LexAural staff open them only to support you, to keep the service working, to carry out a professional service you requested, or when the law requires it.

LexAural does not use uploaded recordings or confidential case file materials to train a general-purpose machine-learning model unless that use is separately disclosed and expressly authorized. De-identified or aggregated technical information may be used to evaluate and improve system performance, provided it does not identify a user, client, matter, or submitted work.

4. Legal Basis

We process your information under the legal basis of legitimate business interest, consent (when applicable), and compliance with legal obligations.

5. Sharing Information

We do not sell your personal data. We may share your information with service providers who help operate our business, or when legally required to do so.

Portal information is processed by providers that support hosting, database storage, authentication, file storage, payment processing, transactional email, security, and automated music analysis. These are Supabase (database, authentication, and file storage), Stripe (payments), Resend (email), and Hostinger (website hosting and the server that runs the automated analysis). Payment processors may collect transaction and fraud-prevention information under their own privacy terms.

On a team, the team’s owner and administrators can access every case file on the team, including its recordings, reports, and comments, and the team’s billing and credit information. Other members can access only the case files they opened or were added to. Team owners and administrators are responsible for adding only people who are authorized to access those materials.

6. Data Security

We implement appropriate technical and organizational safeguards to protect your information. However, no system is entirely secure, and we cannot guarantee absolute security.

7. Data Retention

We retain your information only as long as needed to fulfill the purposes outlined in this policy or to comply with legal, contractual, or professional obligations.

Uploaded audio recordings are deleted automatically 90 days after the comparison that used them is completed. This happens whether or not you request it. After deletion, the automated report, the note data transcribed from the recordings, passage timings, measurements, method details, and your comments remain in the case file, but the audio can no longer be played back from the report. If you expect to need in-portal playback beyond that period, keep your own copies of the recordings.

You can delete a comparison or case file yourself at any time. Deletion permanently removes its recordings, reports, note data, marked passages, and comments. A comparison or case file linked to a professional service request or invoice can be archived but not deleted, because we keep those materials under the terms of that service. The record that a credit was used stays in your billing history after the comparison is deleted.

You may also ask us to delete other materials early, subject to legal, contractual, billing, dispute-resolution, backup, security, and professional-recordkeeping requirements. Leaving a team may not delete materials that belong to that team. We may retain limited records of transactions, consent, account security, and deletion requests after other content is removed. Backup copies may persist for a limited period after deletion before they are overwritten in the ordinary course.

8. Cookies and Tracking

Our website may use cookies or similar technologies to enhance your browsing experience. You may disable cookies in your browser settings.

9. International Users

LexAural is based in the United States. By using our site, you consent to your data being processed in the U.S. and potentially other jurisdictions.

10. Children's Privacy

Our services are not directed toward children under 13. We do not knowingly collect information from children. If such data is discovered, it will be promptly deleted.

11. Confidential and Professional Communication

Client interactions, especially those involving legal or forensic musicology services, are treated with discretion and, where applicable, may be governed by confidentiality agreements or NDAs.

Use of the automated comparison portal alone does not establish a professional engagement, create attorney-client privilege, or guarantee that submitted materials are protected by attorney work-product doctrine or another legal privilege. Users should consult their own legal counsel before submitting materials whose privileged or confidential status may be affected by disclosure to a third-party service.

12. Submitted Recordings and User Authority

Users retain their rights in recordings and other materials they submit. By uploading material, a user represents that the user has a lawful basis to possess and submit it for the requested analysis and authorizes LexAural and its service providers to host, copy, process, analyze, and display the material solely as reasonably necessary to provide, secure, support, and administer the requested service.

Uploading material does not transfer ownership of the underlying music or recording to LexAural. Users should not upload material that they are prohibited from disclosing or processing.

13. Your Rights

You may request access to, correction of, or deletion of your personal data. You may also opt out of communications by contacting us.

Depending on where you live, additional rights may apply, including rights concerning access, correction, deletion, portability, restriction, objection, or appeal. We may need to verify your identity and authority before completing a request.

14. Changes to This Policy

We may revise this policy from time to time. Updates will be posted on this page with a revised date.
